1. Introduction and Acceptance of Terms
1.1 Agreement to Terms
These Terms and Conditions ("Terms", "Terms of Service", or "Agreement") constitute a legally binding agreement between you ("you", "your", "User", "Athlete", or "Club") and MOJOE COMMUNITY LTD (Company No. 15763396), a company incorporated and registered in England and Wales with its registered office at 1 Chapel Court, Holly Walk, Leamington Spa, Warwickshire, England, CV32 4YS ("MOJOE", "we", "us", or "our").
By accessing, registering for, or using our digital career coaching platform for athletes (the "Platform", "Services", or "Application"), including our mobile application and web-based dashboard, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy.
IF YOU DO NOT AGREE TO THESE TERMS, DO NOT ACCESS OR USE OUR SERVICES.
1.2 Age Requirement
By using our Services, you represent and warrant that you are 16 years of age or older. If you are under 16, you are prohibited from accessing or using the Services.
1.3 Modifications to Terms
We reserve the right to modify, amend, or update these Terms at any time at our sole discretion. We will notify you of material changes by:
Sending an email to the address associated with your account at least 30 days before the changes take effect
Displaying a prominent notice on the Platform
Requiring you to accept the updated Terms upon your next login (for material changes)
Your continued use of the Services after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Services and may delete your account in accordance with Section 15.
1.4 Additional Terms
Certain features or services may be subject to additional terms and conditions, which will be presented to you at the time you access those features. Such additional terms are incorporated by reference into these Terms.
1.5 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and MOJOE regarding your use of the Services and supersede all prior agreements, understandings, and communications, whether written or oral.
2. Definitions
For the purposes of these Terms, the following definitions apply:
"Account" means the user profile created to access and use the Services.
"Athlete" or "Athlete User" means an individual user who accesses the mobile application to receive career coaching services, whether through a self-purchased subscription or a Club-provided subscription.
"Club" or "Club User" means a sports organization, team, or similar entity that purchases subscriptions on behalf of Athletes and accesses the web-based admin dashboard to monitor Athlete progress.
"Content" means all text, graphics, images, data, software, and other materials available through the Services, including User-Generated Content and MOJOE Content.
"Freemium Tier" means the free version of the Services with limited features, available to all users without payment.
"MOJOE Content" means all content owned, developed, or licensed by MOJOE, including but not limited to the Platform software, AI models, job listings, mentor profiles, learning resources, and proprietary algorithms.
"Premium Subscription" or "Pro Mode" means a paid subscription providing full access to all Platform features.
"Services" means the MOJOE digital career coaching platform, including the mobile application, web dashboard, AI Career Coach, and all related features and functionality.
"User-Generated Content" or "UGC" means any content created, uploaded, or submitted by Users, including profile information, CVs/resumes, career goals, messages to the AI Coach, and other contributions.
3. Account Registration and Security
3.1 Account Creation
To use the Services, you must create an Account by providing:
Full name
Email address
Date of birth (to verify you are 16 or older)
Password
Athletic status (current athlete, retired athlete, or not an athlete)
Primary career goal
You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.
3.2 One Account Per Person
Each individual may create and maintain only one Account. Creating multiple accounts for the same individual is prohibited and may result in suspension or termination of all associated accounts. This restriction applies to both Athlete Users and Club administrative users.
3.3 Account Security
You are responsible for:
Maintaining the confidentiality of your account credentials (email and password)
All activities that occur under your Account
Notifying MOJOE immediately of any unauthorized use of your Account or any other security breach
You agree not to:
Share your account credentials with any third party
Allow any third party to access your Account
Use another person's Account without permission
MOJOE is not liable for any loss or damage arising from your failure to protect your account credentials or from unauthorized use of your Account.
3.4 Account Verification
We may require you to verify your email address through a one-time password (OTP) or other verification method. You may not be able to access certain features until verification is complete.
3.5 Account Accuracy
You represent and warrant that:
All information provided during registration is truthful and accurate
You are legally capable of entering into binding contracts
Your use of the Services does not violate any applicable law or regulation
You are not prohibited from using the Services under any applicable law
4. Services Description
4.1 Platform Overview
MOJOE provides a digital career coaching platform designed to support athletes transitioning from sports to second careers. The Platform offers:
For Athletes (Mobile Application):
AI-powered Career Coach chatbot for personalized guidance
Job discovery and search with advanced filtering
Mentor directory and networking opportunities
CV/resume builder with AI assistance
Learning goals and achievement tracking
Career assessment and progress monitoring
Premium job listings and opportunities (Premium tier)
For Clubs (Web Dashboard):
Athlete roster management and monitoring
Individual athlete progress and engagement tracking
Aggregated performance metrics and analytics
Dashboard insights and reporting
Admin tools for subscription management
4.2 Service Tiers
Freemium Tier (Free):
Access to AI Career Coach with usage limits
Limited job viewing (restrictions apply)
Limited mentor access (up to 3 mentors)
Basic CV builder
Learning goal tracking
Achievement badges
Premium Tier (Paid Subscription):
Unlimited AI Career Coach usage
Unlimited job viewing and premium job listings
Unlimited mentor access
Advanced CV builder with AI assistance and PDF export
Priority support
All Freemium features without limitations
4.3 Feature Availability
We reserve the right to:
Add, modify, or discontinue features at any time with or without notice
Impose usage limits on certain features (e.g., AI Coach messages per day, job views per day)
Change feature availability between Freemium and Premium tiers
Introduce new features exclusively for Premium subscribers
4.4 Service Availability
The Services are provided on an "as is" and "as available" basis. We do not guarantee:
Uninterrupted or error-free operation of the Services
That the Services will be available at all times
Any specific uptime or service level agreements (SLAs) unless expressly agreed in a separate written agreement with Club subscribers
We may suspend or discontinue the Services at any time for maintenance, updates, or other reasons, with or without prior notice.
4.5 Platform Updates
We regularly update the Platform to:
Improve features and functionality
Fix bugs and security vulnerabilities
Add new capabilities
Maintain compatibility with operating systems and devices
You agree that we may automatically update the mobile application and web platform without notice. Some updates may be required to continue using the Services.
5. Subscription Plans and Pricing
5.1 Athlete Subscription Plans
The following subscription plans are available for individual Athletes purchasing directly through the mobile application:
Monthly Plan:
Price: £9.99 per month
Billing Cycle: Monthly, on the date of initial subscription
Auto-Renewal: Automatically renews each month unless cancelled
Six-Month Plan:
Price: £49.99 per 6 months
Billing Cycle: Every 6 months from the date of initial subscription
Auto-Renewal: Automatically renews every 6 months unless cancelled
Savings: Save 16% compared to monthly billing
Annual Plan:
Price: £89.99 per year
Billing Cycle: Annually, on the date of initial subscription
Auto-Renewal: Automatically renews each year unless cancelled
Savings: Save 25% compared to monthly billing
5.2 Pricing Changes
We reserve the right to change our pricing at any time. For existing subscribers:
Individual Athletes: We will provide at least 30 days' notice before any price increase takes effect. Price changes will apply to your next renewal period.
Club Subscribers: Pricing changes are governed by your existing contract and will not apply until contract renewal.
If you do not agree to a price increase, you may cancel your subscription before the new pricing takes effect.
5.3 Currency and Taxes
All prices are stated in British Pounds Sterling (GBP). You are responsible for any applicable taxes, duties, or fees imposed by your local jurisdiction. Where required by law, we will collect and remit applicable taxes.
5.4 Payment Methods
Individual Athlete subscriptions are processed through:
Apple Pay (for iOS users via Apple App Store)
Google Pay (for Android users via Google Play Store)
By subscribing, you authorize us to charge the applicable subscription fee to your selected payment method on a recurring basis according to your chosen billing cycle.
5.5 Auto-Renewal
Individual Athlete subscriptions automatically renew at the end of each billing cycle unless you cancel your subscription before the renewal date. You will be charged the then-current subscription price for your plan.
To cancel auto-renewal:
iOS users: Manage your subscription through your Apple App Store account settings
Android users: Manage your subscription through your Google Play Store account settings
Cancellation must be completed at least 24 hours before the end of your current billing cycle to avoid being charged for the next period.
6. Payment Terms
6.1 Payment Authorization
By subscribing to a Premium plan, you authorize MOJOE and our third-party payment processors (Apple, Google) to charge your selected payment method for:
The initial subscription fee
Recurring subscription fees for each renewal period
Any applicable taxes or fees
6.2 Payment Processing
Payments are processed by:
Apple Inc. for iOS in-app purchases (subject to Apple's Terms of Service)
Google LLC for Android in-app purchases (subject to Google's Terms of Service)
We do not directly handle or store payment card information. All payment processing is governed by the payment processor's terms and privacy policies.
6.3 Failed Payments
If payment fails due to insufficient funds, expired card, or other reasons:
We will attempt to process the payment again within a reasonable period
Your access to Premium features may be temporarily suspended until payment is successful
If payment remains unsuccessful after multiple attempts, your subscription may be cancelled and your account reverted to Freemium tier
You are responsible for ensuring your payment method remains valid and has sufficient funds.
6.4 No Refunds Policy
ALL SUBSCRIPTION PAYMENTS ARE FINAL AND NON-REFUNDABLE.
We do not offer refunds or credits for:
Partial subscription periods (e.g., if you cancel mid-month)
Unused subscription time
Dissatisfaction with the Services
Changes in circumstances (e.g., career changes, loss of athletic status)
Features you did not use
Any other reason
Exceptions: Refunds may be provided at our sole discretion in the following circumstances:
Technical issues that prevented you from accessing the Services for an extended period
Duplicate charges or billing errors
Where required by applicable law (e.g., certain consumer protection regulations)
To request a refund in exceptional circumstances, contact info@joinmojoe.com with your account details and explanation. Refund requests must be submitted within 14 days of the charge.
6.5 Subscription Cancellation
Athlete Users:
You may cancel your subscription at any time through your Apple App Store or Google Play Store account settings
Cancellation stops future charges but does not refund current period payments
You retain access to Premium features until the end of your paid subscription period
After the subscription period ends, your account automatically reverts to Freemium tier
No notice period is required
Effect of Cancellation:
You will not be charged for subsequent billing cycles
Your access continues until the end of the current paid period
After expiration, Premium-only features become inaccessible
Your data and account remain intact; you can re-subscribe at any time
6.6 Downgrade to Freemium
If you do not renew your Premium subscription or it expires:
Your account automatically reverts to Freemium tier
You lose access to Premium-only features
Your data (CV, goals, chat history) is retained but may have limited access or export capabilities
Usage limits apply (e.g., limited job views, limited AI Coach messages)
You may upgrade to Premium at any time to regain full access
7. Club Subscriptions
7.1 Club Subscription Model
Sports clubs and organizations may purchase subscriptions on behalf of their Athletes through a separate contractual agreement with MOJOE. Club subscriptions are not purchased through the mobile application payment systems.
7.2 Separate Agreements
Club subscriptions are governed by:
These Terms and Conditions (general provisions)
A separate written contract between the Club and MOJOE specifying:
Number of Athlete subscriptions purchased
Subscription period and renewal terms
Pricing and payment terms
Service level commitments (if any)
Data access and reporting provisions
In the event of any conflict between these Terms and the Club's separate contract, the separate contract prevails.
7.3 Referral Code System
Clubs provide Athletes with referral codes to access the Platform. By using a referral code:
The Athlete's subscription is funded by the Club
The Club gains access to the Athlete's usage data, progress, and engagement metrics via the admin dashboard (as detailed in our Privacy Policy)
The Athlete consents to data sharing with the Club by continuing to use the Services
7.4 Club Admin Dashboard Access
Clubs receive access to a web-based admin dashboard that displays:
Individual Athlete profiles and engagement data
Usage metrics (login frequency, features used, time spent)
Career goals and progress tracking
CV completion status
Achievement badges and milestones
Aggregated analytics across all Athletes
Athletes acknowledge and consent that Clubs can view their individual data when using a Club-funded subscription.
7.5 Club Subscription Payments
Club subscriptions are invoiced according to the separate contract
Payment terms are specified in the contract (typically net 30 days from invoice)
Auto-renewal does NOT apply to Club subscriptions; renewal is subject to contract negotiation
Clubs must provide 6 months' notice to terminate the subscription agreement (unless otherwise specified in the contract)
7.6 Non-Refundable Policy for Clubs
ALL CLUB SUBSCRIPTION PAYMENTS ARE FINAL AND NON-REFUNDABLE, including:
If the Club terminates the agreement mid-term
If Athletes do not actively use the Services
If Athletes leave the Club or retire
For any unused subscription allocations
Exception: Refunds may be considered in exceptional circumstances such as prolonged service outages or material breach of contract by MOJOE.
7.7 Mid-Contract Termination by Club
If a Club cancels the subscription agreement before the contract period ends:
No refund is provided for the remaining subscription period
Athletes retain access to Premium features until the end of the paid period
After the paid period expires, Athletes' accounts revert to Freemium tier (unless they purchase individual subscriptions)
The Club loses dashboard access at the end of the paid period
7.8 Athlete Departure from Club
If an Athlete leaves a Club or the Club no longer wishes to fund their subscription:
The Athlete retains access until the end of the current paid period
The Athlete may purchase an individual subscription to maintain Premium access
Historical data generated during the Club subscription period remains accessible to the Club (as per the Privacy Policy)
The Athlete retains their account and data; they are not required to delete their account
7.9 Data Ownership and Retention
Both the Club and the Athlete retain access to data generated during the Club subscription period
MOJOE owns all data as specified in Section 9 and the Privacy Policy
Clubs may export reports and dashboard data for their records
Athletes may delete their accounts at any time, which anonymizes their personal data (see Privacy Policy Section 8)
8. User Conduct and Acceptable Use
8.1 Prohibited Activities
You agree not to engage in any of the following prohibited activities:
Illegal Activities:
Violate any applicable local, national, or international law or regulation
Engage in fraudulent, deceptive, or misleading conduct
Infringe upon any third party's intellectual property, privacy, or other rights
Use the Services to facilitate illegal activities
Platform Abuse:
Attempt to gain unauthorized access to the Platform, other user accounts, or computer systems or networks connected to the Services
Use automated tools (bots, scrapers, crawlers) to access, extract, or collect data from the Services
Reverse engineer, decompile, disassemble, or otherwise attempt to discover the source code or underlying algorithms of the Platform
Interfere with or disrupt the Services or servers or networks connected to the Services
Circumvent or attempt to circumvent any access restrictions, security measures, or usage limits
Content Violations:
Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or otherwise objectionable
Impersonate any person or entity or falsely state or misrepresent your affiliation with any person or entity
Upload or transmit viruses, malware, or any other malicious code
Spam, send unsolicited messages, or engage in any form of advertising or commercial solicitation without permission
Account Violations:
Create multiple accounts for the same individual (see Section 3.2)
Share your account credentials or allow others to use your account
Sell, transfer, or sublicense your account to any third party
Use another person's account without authorization
Data and Privacy Violations:
Collect or harvest personal information of other users without consent
Use the Services to stalk, harass, or harm another individual
Violate any user's privacy or data protection rights
8.2 Reporting Violations
If you become aware of any violation of these Terms or any abusive, harmful, or illegal content or behavior on the Platform, please report it immediately to info@joinmojoe.com.
8.3 Consequences of Violations
Violation of these Terms may result in enforcement actions as outlined in Section 15 (Account Termination and Suspension), including:
Warning
Temporary suspension
Permanent termination of your account
Legal action where appropriate
8.4 Monitoring and Enforcement
We reserve the right, but are not obligated, to:
Monitor user conduct and content on the Platform
Investigate violations of these Terms
Remove or disable access to any content that violates these Terms
Report illegal activities to law enforcement authorities
Cooperate with law enforcement investigations
8.5 No Duty to Monitor
MOJOE is not responsible for monitoring user conduct or content. We do not pre-screen content and assume no liability for User-Generated Content or third-party conduct on the Platform.
9. Content Ownership and Intellectual Property Rights
9.1 MOJOE's Intellectual Property
Ownership: MOJOE and its licensors own all rights, title, and interest in and to the Services and MOJOE Content, including but not limited to:
The MOJOE Platform (mobile application, web dashboard, APIs)
All software, code, algorithms, and technology underlying the Services
The MOJOE brand, name, logo, trademarks, and service marks
AI models, including our AI Career Coach, job matching algorithms, mentor matching algorithms, and CV enhancement tools
Job listings curated or created by MOJOE
Mentor profiles (to the extent created or curated by MOJOE)
Learning content, goals, and achievement definitions
User interface designs, graphics, and visual elements
Documentation, guides, and support materials
Proprietary data, analytics, and insights derived from the Platform
Protection: All MOJOE Content is protected by copyright, trademark, patent, trade secret, and other intellectual property laws of the United Kingdom, United States, European Union, and international treaties.
9.2 Limited License to Users
Subject to your compliance with these Terms, MOJOE grants you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to:
Access and use the Services for your personal, non-commercial purposes
View and interact with MOJOE Content as part of your use of the Services
Download and export your CV/resume in PDF format for your personal use
Restrictions: You may not:
Copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, or sell any MOJOE Content
Use the MOJOE name, logo, or trademarks without our prior written consent
Remove, obscure, or alter any copyright, trademark, or other proprietary notices
Use the Services or MOJOE Content for any commercial purpose without authorization
Scrape, parse, or systematically extract data from the Platform
Replicate, copy, or create a competing service based on the Services
Reverse engineer or attempt to extract the AI models, algorithms, or source code
9.3 Feedback and Suggestions
If you provide MOJOE with any feedback, suggestions, ideas, or recommendations regarding the Services ("Feedback"), you grant MOJOE an unrestricted, perpetual, irrevocable, worldwide, royalty-free license to use, reproduce, modify, create derivative works from, and commercialize such Feedback without any obligation or compensation to you.
9.4 Third-Party Intellectual Property
Certain content on the Platform may be owned by third parties (e.g., job listings from employers, mentor profiles). Such content is the property of the respective third parties and is used by MOJOE with permission or under applicable licenses. You may not use such third-party content except as permitted by these Terms and the third party's own terms.
9.5 DMCA and Copyright Complaints
If you believe that any content on the Platform infringes your copyright, please notify us at info@joinmojoe.com with:
Identification of the copyrighted work claimed to be infringed
Identification of the allegedly infringing content on the Platform
Your contact information
A statement of good faith belief that the use is not authorized
A statement that the information in the notification is accurate and, under penalty of perjury, that you are authorized to act on behalf of the copyright owner
We will respond to valid DMCA notices in accordance with applicable law.
10. User-Generated Content License
10.1 Ownership of User-Generated Content
MOJOE's Ownership: As detailed in our Privacy Policy, MOJOE owns all data and content you provide or generate through the Services, including but not limited to:
Profile information and career goals
CV/resume content, work experience, education history
Messages and conversations with the AI Career Coach
Learning goals, achievements, and progress data
Job search queries and preferences
Any other content you create, upload, or submit
By using the Services, you acknowledge and agree that all User-Generated Content becomes the property of MOJOE upon creation or submission.
10.2 Rights Granted by Users to MOJOE
You grant MOJOE a perpetual, irrevocable, worldwide, royalty-free, fully paid-up, transferable, sublicensable license to:
Use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display your User-Generated Content in any media or format
Anonymize, de-identify, and aggregate your content for AI training, analytics, research, and commercial purposes
Share anonymized content with third parties, including for sale or licensing
Incorporate your content into AI models, datasets, and research outputs
Important: This license survives termination of your account. Even after account deletion, MOJOE retains rights to anonymized, de-identified, or aggregated data derived from your User-Generated Content (see Privacy Policy Section 8).
10.3 User's Right to Use Their Own Content
Notwithstanding MOJOE's ownership, you retain the right to:
Use your own CV/resume content elsewhere (e.g., apply for jobs, share with potential employers, upload to other platforms)
Export your CV in PDF format through the Platform
Copy and use your career goals, work experience descriptions, and other content you created for your own purposes outside the Platform
Clarification: You may use your content, but MOJOE also owns and may use that same content as described above. This is not an exclusive license to MOJOE; you retain concurrent usage rights for your personal and professional purposes.
10.4 Content Representations and Warranties
By submitting User-Generated Content, you represent and warrant that:
You have the right to provide the content and grant the licenses in these Terms
Your content does not violate any third party's intellectual property, privacy, or other rights
Your content is accurate and not misleading or fraudulent
Your content does not violate any applicable law or regulation
Your content does not contain viruses, malware, or other harmful code
10.5 Content Responsibility
You are solely responsible for your User-Generated Content. MOJOE does not endorse, support, or guarantee the accuracy, completeness, or reliability of any User-Generated Content. We assume no liability for any content posted by users.
10.6 Content Removal
MOJOE reserves the right, but is not obligated, to:
Review, monitor, or remove any User-Generated Content at any time for any reason
Remove content that violates these Terms or is otherwise objectionable
Preserve content and disclose it to law enforcement or regulatory authorities if required by law or if we believe it is necessary to protect our rights or the rights of others
10.7 No Compensation
You acknowledge that MOJOE may derive commercial value from your User-Generated Content (e.g., through AI training, analytics, or data licensing). You are not entitled to any compensation for MOJOE's use of your content, whether directly or indirectly.
11. AI-Powered Features and Limitations
11.1 AI Career Coach
Our AI Career Coach is powered by third-party artificial intelligence models (including OpenAI GPT-4 and Meta Llama) and is designed to provide personalized career guidance, advice, and support.
Nature of AI Advice:
The AI Career Coach provides general career guidance, suggestions, and information
Responses are generated by machine learning algorithms based on patterns in training data and your inputs
The AI Coach is not a human career counselor, therapist, or professional advisor
AI-generated content may contain errors, inaccuracies, or incomplete information
11.2 No Professional Advice
CRITICAL DISCLAIMER: The AI Career Coach and all other AI-powered features do not constitute:
Professional career counseling or coaching services
Legal, financial, medical, or mental health advice
Employment advice or job placement services
Guaranteed career outcomes or success
You should not rely solely on AI-generated advice for important career decisions. We strongly recommend consulting with qualified human professionals (career counselors, mentors, legal advisors, etc.) before making significant career or life decisions.
11.3 No Guarantee of Accuracy
We do not guarantee that:
AI-generated advice is accurate, complete, or current
AI responses are suitable for your individual circumstances
Following AI recommendations will result in successful career outcomes
AI job matches or mentor recommendations are optimal for you
11.4 User Responsibility
You are solely responsible for:
Evaluating the accuracy and suitability of AI-generated advice
Making your own independent career decisions
Verifying information provided by the AI Coach
Seeking professional advice when appropriate
11.5 AI Training and Improvement
As detailed in our Privacy Policy and Section 10:
Your conversations with the AI Coach are used to train and improve our AI models
Conversations are anonymized before use in training
We may share anonymized conversation data with third parties for AI development purposes
11.6 Limitations and Errors
AI-powered features may:
Provide outdated, incorrect, or irrelevant information
Misunderstand your queries or provide nonsensical responses
Exhibit biases present in training data
Experience technical failures or downtime
Have usage limits or rate limiting
11.7 No Liability for AI Advice
MOJOE IS NOT LIABLE for:
Any decisions you make based on AI-generated advice
Career outcomes resulting from following AI recommendations
Errors, inaccuracies, or omissions in AI-generated content
Any harm or loss resulting from your use of AI-powered features
By using AI-powered features, you acknowledge and accept these limitations and agree to hold MOJOE harmless from any claims arising from your use of AI-generated advice.
12. Third-Party Content and Services
12.1 Job Listings
Third-Party Job Postings: The Platform displays job listings from third-party employers, recruiters, and job boards. MOJOE:
Does not verify the accuracy, completeness, or legality of job listings
Is not responsible for the content of job descriptions, salary information, or application requirements
Does not guarantee that jobs are legitimate, available, or suitable for you
Is not liable for any issues arising from your interaction with employers or application to jobs
User Responsibility: You are solely responsible for:
Evaluating the legitimacy and suitability of job opportunities
Verifying employer information and job details
Protecting your personal information when applying to jobs
Complying with application requirements and employer terms
Any agreements or relationships with employers

IMPORTANT: MOJOE is a career coaching tool and platform. Career success depends on many factors beyond our control, including your skills, experience, qualifications, effort, market conditions, and individual circumstances.
WE ARE NOT LIABLE for:
Failure to secure employment or career opportunities
Unsatisfactory career outcomes or transitions
Loss of income or career setbacks
Any other career-related results or lack thereof
13.4 Service Availability
We do not guarantee:
Uptime or availability of the Services at any particular time
Uninterrupted access to any feature or functionality
That the Services will be free from bugs, errors, or technical issues
That the Platform will be compatible with your device or software
13.5 Content Accuracy

14. Limitation of Liability
14.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MOJOE, ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, AFFILIATES, AND LICENSORS SHALL NOT BE LIABLE FOR ANY:
Indirect, Incidental, or Consequential Damages, including but not limited to:
Loss of profits, revenue, or income
Loss of business opportunities or employment
Loss of data or information
Cost of substitute services
Career setbacks or failures
Emotional distress or reputational harm
Direct Damages arising from:
Your use of or inability to use the Services
Any content, advice, or information obtained through the Services
Unauthorized access to your account or data
Errors, bugs, or technical issues with the Platform
Third-party conduct or content
Service interruptions or downtime
This limitation applies regardless of the legal theory (contract, tort, negligence, strict liability, or otherwise) and whether or not MOJOE was advised of the possibility of such damages.
14.2 Limitation of Total Liability
TO THE EXTENT LIABILITY CANNOT BE EXCLUDED, MOJOE'S TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED:
For Individual Athletes: The total amount you paid to MOJOE in subscription fees during the 12 months immediately preceding the claim, or £100 (one hundred pounds sterling), whichever is greater.
For Club Subscribers: The total amount paid by your Club to MOJOE under the applicable contract during the 12 months immediately preceding the claim.
14.3 No Liability for Career Outcomes
CRITICAL: MOJOE is not liable for any career-related outcomes, including:
Failure to secure employment or job offers
Rejection from job applications or opportunities
Loss of employment or income
Unsatisfactory career transitions or decisions
Failure to achieve career goals
Any other career success or failure
Your career outcomes depend on factors outside MOJOE's control. You use the Services at your own risk and are solely responsible for your career decisions.
14.4 No Liability for Third Parties
MOJOE is not liable for:
Actions, conduct, or content of employers, mentors, or other users
Accuracy or availability of job listings
Quality or suitability of mentor relationships
Third-party services or websites linked from the Platform
Failures, breaches, or issues with third-party service providers
14.5 Force Majeure
MOJOE is not liable for any failure or delay in performance due to circumstances beyond our reasonable control, including:
Acts of God, natural disasters, pandemics
War, terrorism, civil unrest
Internet or telecommunications failures
Government actions or regulations
Third-party service provider failures
14.6 Basis of the Bargain
You acknowledge that the limitations and exclusions in this Section 14 are fundamental elements of the agreement between you and MOJOE. The Services would not be provided at the current pricing and terms without these limitations. These limitations apply even if a remedy fails of its essential purpose.
14.7 Jurisdiction-Specific Rights
Some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages. If you reside in such a jurisdiction, some of the above limitations may not apply to you, and you may have additional rights under local law.
15. Account Termination and Suspension
15.1 Termination by User
Athlete Users: You may terminate your account at any time by:
Navigating to Settings in the mobile application
Selecting "Delete Account"
Confirming your deletion request
Alternatively, you may request account deletion by emailing info@joinmojoe.com.
Effect of Athlete Termination:
Your access to the Services is immediately terminated
Your personal data is anonymized as described in the Privacy Policy (Section 8)
If you have an active Premium subscription, no refund is provided for the remaining period
MOJOE retains anonymized data as described in the Privacy Policy
Notice Period: Athletes may terminate their account immediately without notice.
Club Users: Clubs must provide 6 months' written notice to terminate their subscription agreement, as specified in the separate contract. Early termination does not result in refunds (see Section 7.6).
15.2 Termination by MOJOE
MOJOE may suspend or terminate your account and access to the Services at any time, with or without cause, including but not limited to:
Violation of these Terms
Fraudulent, abusive, or illegal conduct
Non-payment of subscription fees
Prolonged inactivity
At our sole discretion for any reason or no reason
MOJOE may terminate accounts with or without prior notice, depending on the severity of the violation or circumstances.
15.3 Progressive Enforcement for Terms Violations
For violations of Section 8 (User Conduct and Acceptable Use), MOJOE will typically follow a progressive enforcement process:
Step 1: Warning (First Violation)
We will send you a written warning via email identifying the violation
You will be given an opportunity to correct the behavior
Your account remains active
Warning remains on your account record
Step 2: 7-Day Waiting Period
After receiving a warning, you have 7 days to cease the prohibited conduct
If violations continue, or if you commit additional violations, we proceed to Step 3
Step 3: Temporary Suspension (Second Violation or Continued Violation)
Your account is suspended for 1 month (30 days)
You cannot access the Services during suspension
If you have an active Premium subscription, you are not entitled to a refund or extension for the suspension period
After 1 month, your account is reinstated (if you have complied with these Terms)
Further violations after reinstatement proceed to Step 4
Step 4: Permanent Termination (Third Violation or Serious Violations)
Your account is permanently terminated
You are banned from creating new accounts or accessing the Services
No refund is provided for any remaining subscription period
Your data is anonymized as described in the Privacy Policy
Exceptions - Immediate Termination: MOJOE reserves the right to immediately terminate your account without warning or progressive enforcement for:
Severe violations (e.g., illegal activity, hacking, fraud)
Threats of violence or harm to others
Posting illegal content (e.g., child exploitation material)
Violations that pose immediate risk to MOJOE, other users, or the public
Repeated violations after prior terminations
15.4 Effect of Termination
Upon termination of your account (by you or by MOJOE):
Immediate Effects:
Your access to the Services is revoked
You lose access to Premium features (if applicable)
You cannot log in or use the mobile application or web dashboard
Data Handling:
Your personal data is anonymized in accordance with the Privacy Policy (Section 8)
MOJOE retains anonymized data for 10 years and may use it indefinitely for AI training and other purposes
You cannot recover your data after termination
No Refunds:
Termination does not entitle you to a refund of any subscription fees paid
If MOJOE terminates your account for a Terms violation, no refund is provided
If you terminate your account voluntarily, no refund is provided for the remaining subscription period
Outstanding Obligations:
You remain liable for any outstanding payments owed to MOJOE
Termination does not relieve you of obligations incurred prior to termination
Survival of Terms: The following provisions survive termination:
Sections 9 (Content Ownership), 10 (User-Generated Content License), 13 (Disclaimers), 14 (Limitation of Liability), 17 (Indemnification), 18 (Dispute Resolution), and 19 (General Provisions)
15.5 Account Suspension (Temporary)
MOJOE may temporarily suspend your account without termination in the following circumstances:
Pending investigation of Terms violations
Failed or disputed payments
Security concerns or suspected unauthorized access
At our discretion for operational reasons
During suspension:
You cannot access the Services
Your data is retained but inaccessible to you
If you have an active subscription, you are not entitled to a refund or extension for the suspension period
Suspensions may be lifted after resolution of the issue, or may result in permanent termination if warranted.
15.6 Re-Registration After Termination
If your account was terminated by MOJOE for a Terms violation, you are prohibited from creating a new account unless we provide explicit written permission. Attempting to circumvent a ban by creating new accounts may result in legal action.
If you voluntarily terminated your account, you may create a new account at any time, but your previous data cannot be recovered.
16. Privacy and Data Protection
16.1 Privacy Policy Incorporation
Our Privacy Policy is incorporated into these Terms by reference and forms an integral part of this Agreement. By agreeing to these Terms, you also agree to our Privacy Policy.
16.2 Data Collection and Use
We collect, use, and share your personal information as described in our Privacy Policy, including:
Personal information provided during registration and use
Usage data collected automatically
Data shared with service providers and third parties
Anonymized data for AI training and commercial purposes
16.3 Consent to Data Practices
By using the Services, you consent to:
MOJOE's ownership of all data you provide or generate (see Privacy Policy Section 6)
Collection and processing of your personal information
International transfers of data to the United States and other countries
Sharing of your data with sports clubs (if using a Club subscription)
Anonymization and retention of data after account deletion
Use of anonymized data for AI training, analytics, and commercial purposes
16.4 Club Data Access
If you are using a Club-funded subscription:
You expressly consent to your Club viewing your individual usage data, progress, and engagement metrics through the admin dashboard
This consent is granted by continuing to use the Services after your Club provides you access
Clubs can view your profile, career goals, CV status, achievements, and activity data
You acknowledge that your Club may use this data for athlete welfare, performance monitoring, and administrative purposes
16.5 Your Privacy Rights
You have certain rights regarding your personal information, including:
Right to access your data
Right to correct inaccurate data
Right to delete your account (which anonymizes your data)
Rights under GDPR (if in EEA, UK, or Switzerland)
Rights under CCPA (if in California)

16.6 Data Security

We may update our Privacy Policy from time to time. Material changes will be communicated as described in the Privacy Policy. Your continued use of the Services after changes take effect constitutes acceptance of the updated Privacy Policy.
17. Indemnification
17.1 Your Indemnification Obligation
You agree to indemnify, defend, and hold harmless MOJOE COMMUNITY LTD, its parent, subsidiaries, affiliates, officers, directors, employees, agents, partners, licensors, and service providers (collectively, "MOJOE Parties") from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising from or relating to:
Your Use of the Services:
Your access to or use of the Platform
Any violation of these Terms by you
Any violation of applicable law or regulation by you
Your Content:
Any User-Generated Content you provide or create
Any claim that your content infringes or violates any third party's intellectual property, privacy, or other rights
Any false, misleading, or fraudulent information you provide
Your Conduct:
Any harm or damage caused by your conduct to MOJOE, other users, or third parties
Any disputes or issues arising from your interactions with employers, mentors, or other users
Any misuse of the Services or prohibited activities
Third-Party Claims:
Any claims by employers, mentors, or third parties arising from your conduct or content
Any claims related to your job applications or employment relationships
Any claims related to your mentoring relationships or networking activities
17.2 Defense and Settlement
MOJOE reserves the right, at its own expense, to assume the exclusive defense and control of any matter subject to indemnification by you. You agree to cooperate with MOJOE's defense of such claims. You may not settle any claim without MOJOE's prior written consent.
17.3 Notice of Claims
You agree to promptly notify MOJOE of any claims or demands for which you may be required to indemnify MOJOE.
17.4 Limitations
Your indemnification obligations are subject to:
You being given prompt written notice of any claim
MOJOE's reasonable cooperation in the defense
Your having sole control of the defense and settlement (unless MOJOE assumes control)
18. Dispute Resolution and Governing Law
18.1 Governing Law
These Terms and any disputes arising from or relating to these Terms or the Services shall be governed by and construed in accordance with the laws of England and Wales, without regard to conflict of law principles.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) shall not apply to these Terms.
18.2 Jurisdiction and Venue
For UK and EEA Residents: Subject to Section 18.4 (Consumer Rights), you agree that any disputes arising from or relating to these Terms or the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.
For Non-UK/EEA Residents: You agree to submit to the exclusive jurisdiction of the courts of England and Wales for resolution of any disputes.
18.3 Informal Dispute Resolution
Before initiating any formal legal proceedings, you agree to first attempt to resolve any dispute informally by contacting MOJOE at info@joinmojoe.com. We will attempt to resolve the dispute through good faith negotiations for at least 30 days.
18.4 Consumer Rights (UK and EEA)
Nothing in these Terms affects your statutory rights as a consumer under UK or EEA consumer protection laws. If you are a consumer resident in the UK or EEA:
You may bring proceedings in the courts of your country of residence
You have the right to use alternative dispute resolution (ADR) or online dispute resolution (ODR) mechanisms
Mandatory consumer protection laws in your jurisdiction apply and may provide you with additional rights
EU Online Dispute Resolution Platform: If you are an EEA consumer, you may use the European Commission's Online Dispute Resolution (ODR) platform available at: https://ec.europa.eu/consumers/odr/
18.5 Class Action Waiver
This section does not apply to UK or EEA residents, who retain all rights under applicable consumer protection laws.
To the extent permitted by law, you agree that:
Any dispute resolution proceedings will be conducted on an individual basis, not as a class, consolidated, or representative action
You waive any right to participate in a class action or class-wide arbitration
You may only seek relief (including monetary, injunctive, or declaratory relief) on an individual basis
18.6 No Waiver
MOJOE's failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision. Any waiver must be in writing and signed by an authorized representative of MOJOE.
18.7 Time Limitation on Claims
To the extent permitted by law, any claim or cause of action arising from or relating to these Terms or the Services must be filed within one (1) year after the claim or cause of action arose. Otherwise, such claim or cause of action is permanently barred.
19. General Provisions
19.1 Entire Agreement
These Terms, together with our Privacy Policy and any additional terms applicable to specific features, constitute the entire agreement between you and MOJOE regarding your use of the Services and supersede all prior or contemporaneous agreements, communications, and understandings, whether written or oral.
For Club subscribers, these Terms are supplemented by the separate written contract between the Club and MOJOE. In the event of conflict, the separate contract prevails.
19.2 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, such provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if such modification is not possible, the provision shall be severed from these Terms.
The invalidity or unenforceability of any provision shall not affect the validity or enforceability of any other provision, and the remaining provisions shall continue in full force and effect.
19.3 Assignment
By MOJOE: MOJOE may assign, transfer, or delegate these Terms and any rights or obligations hereunder, in whole or in part, without your consent, including:
In connection with a merger, acquisition, or sale of assets
To a subsidiary or affiliate
To any successor entity
By You: You may not assign, transfer, or delegate these Terms or any rights or obligations hereunder without MOJOE's prior written consent. Any attempted assignment without consent is void.
19.4 No Third-Party Beneficiaries
These Terms are for the benefit of you and MOJOE only. No third party has any right to enforce or rely on any provision of these Terms, except as expressly provided herein (e.g., indemnified parties in Section 17).
19.5 Force Majeure
MOJOE shall not be liable for any failure or delay in performance of its obligations under these Terms due to circumstances beyond its reasonable control, including but not limited to:
Acts of God, natural disasters, pandemics, epidemics
War, terrorism, civil unrest, strikes, labor disputes
Internet, telecommunications, or utility failures
Government actions, laws, or regulations
Third-party service provider failures or breaches
During a force majeure event, MOJOE's obligations are suspended for the duration of the event. MOJOE will use reasonable efforts to mitigate the effects and resume performance as soon as practicable.
19.6 Headings
The section headings in these Terms are for convenience only and have no legal or contractual effect. They do not affect the interpretation of these Terms.
19.7 Language
These Terms are drafted in English. Any translations provided are for convenience only. In the event of any inconsistency or discrepancy between the English version and any translation, the English version shall prevail.
19.8 Relationship of the Parties
Nothing in these Terms creates any agency, partnership, joint venture, employment, or franchise relationship between you and MOJOE. You have no authority to bind MOJOE or make representations on MOJOE's behalf.

Notices to You: MOJOE may provide notices to you by:

In-app notifications or alerts
Posting on the Platform or website
Any other reasonable means
You consent to receive electronic communications and agree that such communications satisfy any legal requirement that communications be in writing.

You are not located in, under the control of, or a national or resident of any embargoed country
You are not on any government list of prohibited or restricted parties
You will not use the Services in violation of any export control laws
19.11 Electronic Signatures and Communications
You consent to the use of electronic signatures, contracts, orders, and records, and to the electronic delivery of notices, policies, and records of transactions with MOJOE. You waive any rights or requirements under any laws or regulations that require an original (non-electronic) signature or delivery/retention of non-electronic records.

The following provisions survive termination or expiration of these Terms:
